\nNOTICE OF PUBLIC HEARING<\/p>\n <\/b><\/font><\/p>\n Pursuant to Sections 91-2 and 92-41, Hawaii revised Statutes, the Hawaii Public Housing Authority (HPHA), Department of Human Services, hereby provides notice that it will hold public hearings on the proposed changes to: 2) Proposed new Chapter 17-2038, “State Eviction – Practice and Procedure”, HAR.<\/p>\n <\/font>Background<\/u><\/font>: <\/p>\n 1) U.S. Department of Housing and Urban Development (HUD) issued a final rule, effective February 3, 2017, implementing a smoke free zone twenty- five feet away from public housing units and administrative office buildings. The amendments for 17-2028 are adhering to HUD’s final rule, and will expand the prohibition to include maintenance areas and HPHA vehicles.<\/p>\n 2) The HPHA State Low Income Housing (LIPH) program is governed by state and agency statutes and rules. Section 356D-4, Hawaii Revised Statutes (HRS), and Act 204, Session Laws of Hawaii (SLH) 2018, authorize the HPHA to adopt administrative rules with the force and effect of law to govern State evictions. Act 204, SLH 2018, places the State LIPH eviction procedures directly under Chapter 356D, HRS, to be processed as contested case hearings by a State eviction board. The proposed new Chapter 17-2038, HAR, implements the State eviction procedures established under Act 204, SLH 2018. <\/p>\n <\/font>Public Review<\/u><\/font>: The proposed changes to Chapter 17-2028, HAR, and proposed new Chapter 17-2038, HAR, are available for public viewing at the HPHA and site management offices at the following locations between 7:45a.m. to 4:30p.m.<\/p>\n <\/font> HPHA’s Administrative Offices, 1002 N. School Street, Honolulu \n<\/font>And, also available on the HPHA website at HYPERLINK: \nThursday, October 25 2018 at 6:00 p.m.:<\/p>\n <\/b><\/font><\/p>\n Hawaii Public Housing Authority (HPHA) Kealakehe Housing Project Lanakila Homes Conference Room Kapaa Community Hall Kahekili Terrace Office/Community Hall <\/font>All interested persons are invited to provide comments relating to the proposed amendments to 17-2028, HAR, or proposed new Chapter 17-2038, HAR, either orally or in writing. <\/p>\n Oral comments should be presented at the public hearing. All oral and written testimony presented at the public hearing will be considered in preparing the amendments to Chapter 17-2028 and new Chapter 17-2038, HAR. Testimony on changes to Chapter 17-2028 will be accepted first. When testimony on proposed changes to smoking prohibitions is completed, HPHA will accept testimony on the proposed new chapter 17-2038. Persons who cannot attend the hearing and prefer not to provide written comments may phone (808) 721-3512 and leave their comments as a voicemail message. <\/p>\n Written comments may be presented to the presiding officer at the public hearing, or mailed to the Hawaii Public Housing Authority, Attention: HAR Comments, at 1002 North School Street, Honolulu, Hawaii 96817. Written comments may also be faxed to (808) 832-4679, or sent by electronic mail to <\/font>hpha@hawaii.gov<\/u><\/font>. Written comments not presented at the public hearing should be received at HPHA office in Honolulu by 4:30 p.m. Thursday, October 25, 2018.<\/p>\n Any person requiring assistance to participate, such as large print, taped materials, interpreters for sign language or limited English proficiency, etc., should make a request to HPHA at least ten working days prior to the public hearings in order to allow time to make arrangements.
