The State Department of Health (DOH) tentatively proposes to issue National Pollutant Discharge Elimination System (NPDES) permit to discharge storm water associated with construction activity from the Waimea River Mouth Maintenance project site, to receiving State waters, subject to special conditions to:<\/font><\/p>\n

The proposed NPDES permit for the new discharge will expire five (5) years from the date of issuance.<\/p>\n

The project is located at the mouth of the Waimea River and Kikiaola Beach, Waimea, Island of Kauai, Hawaii, TMKs: (4) 1-6-006:003; (4) 1-2-013:001, 003, 039, 040, and 041; and as shown in the revised application, dated October 15, 2018. <\/p>\n

The purpose of the project is to excavate and dredge sand from the Waimea River mouth sandbar to widen the outflow channel from the river to the ocean. The dredged sand will be dewatered in a containment structure and transported to the fill site at Kikiaola Beach. The dredged sand will be placed above the two-foot (2′) elevation which is above the Mean Higher High Water (MHHW) mark elevation of 1.01-foot (1.01′), and below the vegetation line. The permittee is responsible for the design, implementation, operation and maintenance of the Storm Water Pollution Prevention Plan (SWPPP) to ensure that storm water discharges associated with construction activities will not cause or contribute to a violation of HAR, Chapter 11-54; Chapter 11-55; Chapter 11-55 Appendices C. Best Management Practices (BMPs) for storm water runoff and non-storm water sources will be implemented to minimize the discharge of erosion and other pollutants from entering receiving State waters. <\/p>\n

The receiving waters, Pacific Ocean at Waimea River and Kikiaola Beach, is classified by the DOH as Class A, Marine Water. The objective of Class A waters is to protect their use for recreational purposes and aesthetic enjoyment. Any other use shall be permitted as long as it is compatible with the protection and propagation of fish, shellfish, and wildlife, and with recreation in and on these waters. These waters shall not act as receiving waters for any discharge which has not received the best degree of treatment or control compatible with the criteria established for this class. No new sewage discharges will be permitted within embayments.<\/p>\n

Persons wishing to comment upon or object to the proposed NPDES permits or to request a public hearing, should submit their comments or requests in writing no later than 30 calendar days after the date of this notice, either through e mail at: <\/font>cleanwaterbranch@doh.hawaii.gov<\/u><\/font> or by mail at 2827 Waimano Home Road, Room 225, Pearl City, Hawaii 96782.<\/p>\n

Copies of the proposed public notice permit and other information are available for public inspection, Monday through Friday (excluding holidays) from 7:45 a.m. until 4:15 p.m., at the DOH Clean Water Branch (CWB) office located at the 2827 Waimano Home Road #225, Pearl City, HI 96782 and the Kauai District Environmental Health Program Office, 3040 Umi Street, Lihue, Kauai, Hawaii 96766. Copies may be bought. All written comments and requests received on time will be considered. If DOH determines that there is significant public interest, a public hearing may be held after at least 30 calendar days of public notice.<\/p>\n

If DOH’s position is substantially unchanged after considering all timely written comments and all oral comments at any public hearing that may be held, then the DOH will issue the NPDES permit and this action will be final.<\/p>\n
