\nNOTICE OF VIRTUAL PUBLIC HEARING<\/p>\n

<\/b><\/font><\/p>\n

As part of the response to the threat of COVID-19, Governor David Ige issued a Thirteenth Supplementary Proclamation dated September 22, 2020. Please visit the Governor’s Proclamation web page. Chapter 91, Hawaii Revised Statutes (“HRS”), administrative procedure, to the extent necessary such that, at the sole discretion of the department or agency, any administrative hearing may be conducted by telephone or video conference without the parties, department or agency, being physically present in the same location; any deadlines may be waived or suspended; and any administrative hearing procedures, such as, but not limited to, conferences, filing of documents, or service, may be done via telephone or email. <\/p>\n

Pursuant to Chapter 91, Hawaii Revised Statutes, notice is hereby given that the Hawaii State Department of Education (“DOE”), on behalf of the Hawaii State Board of Education (“BOE”), will hold a virtual public hearing to hear all persons interested in the proposal to amend Chapter 27 under Title 8, Hawaii Administrative Rules (“HAR”):<\/p>\n

<\/font> 1. Proposal to amend Chapter 8-27, HAR, Transportation of Students, to make it consistent with the Individuals with Disabilities Education Improvement Act of 2004 (IDEA) by ensuring that transportation shall be provided to eligible students with disabilities who attend a public charter school if such transportation is required as a related service in accordance with the student’s Individualized Education Program or Section 504 Plan;
\n 2. Proposal to amend Chapter 8-27, HAR, Transportation of Students, to make the annual effective date for parent mileage reimbursement consistent with the Internal Revenue Service effective date of January rather than July; and
\n 3. Proposal to make various housekeeping amendments.<\/p>\n

<\/font>PUBLIC TESTIMONY
\n<\/b><\/font>All interested persons shall be afforded the opportunity to submit data, views, or arguments, in writing, on the proposed administrative rules at the time of the virtual public hearing. Persons wishing to submit written testimony are requested to submit an email to macb@k12.hi.us by December 11, 2020.<\/p>\n

Persons who require special assistance or services, such as a sign language interpreter, at the public hearing are invited to call (808) 307-3600 at least ten business days prior to the public hearing.<\/p>\n

<\/font>AVAILABILITY OF COPIES OF THE PROPOSED RULES AND OTHER RELATED INFORMATION
\n<\/b><\/font>To view the proposed rules and download free of charge, visit the State of Hawaii BOE Hawaii Administrative Rules website. <\/p>\n

A copy of the proposed rules may also be mailed to any person who requests a copy. A copying fee of 10 cents per printed page will be assessed resulting in a cost of $1.10 for the amendments to Chapter 8-27, HAR, Transportation of Students. The request must be submitted in writing to the DOE Monitoring and Compliance Branch, P.O. Box 2360, Honolulu, Hawaii 96804. Please include mailing and contact information for the requestor and the required payment, as noted above for the proposed rule, in the form of a check made payable to “Monitoring and Compliance Branch”.<\/p>\n

Decision-making on the proposed administrative rules will take place at a properly noticed BOE General Business Meeting. A date and time of the decision-making meeting will be announced at the public hearing.<\/p>\n
