\n(Docket No. 21-CA-PA-10)<\/p>\n

\n<\/font><\/p>\n

The Department of Health, State of Hawaii, is notifying all interested persons of the proposed settlement between the Department of Health and Kauai Island Utility Cooperative (KIUC). The Department of Health has issued a Notice and Finding of Violation and Order, in Docket No. 18-CA-EO-05, alleging that KIUC violated state air pollution laws, HRS §342B-11, HAR §11-60.1-2, and Covered Source Permit (CSP) No. 0452-01-C, Kapaia Power Station. The Kapaia Power Station had exceeded the shutdown time limit and permit limits of nitrogen oxides and carbon monoxide. <\/p>\n

A Consent Order has been drafted that proposes to settle this case and other violations which includes KIUC, CSP No. 0097-01-C, Port Allen Generating Station’s violations. Interested persons may submit written comments on this proposed settlement to the Department of Health within 30 days of this notice. Comments should be sent to the following:<\/font><\/p>\n
