NOTICE OF APPLICATION FOR VARIANCE RECEIVED BY
\nSTATE OF HAWAII, DEPARTMENT OF HEALTH
\nCommunity Noise Control, Variance Application No. V-1330
\nDocket No. 23-NR-VN-16
\nPursuant to Chapter 342F-5, subsection (h), Hawaii Revised Statutes, the Department
\nof Health seeks written comments from interested persons regarding the following
\nvariance application:
\nThe Hawaii Department of Transportation, 1720 Haleukana Street,
\nLihue, Hawaii 96766, has applied to the Department of Health for a variance from
\nHawaii Administrative Rules, Chapter 11-46, Section 11-46-6 (a), which states, “General
\nProhibition. Without a permit or variance issued pursuant to Section 11-46-7 or 11-46-8,
\nno person within the State shall operate, from any premises or land owned, rented,
\nleased, occupied, or controlled by that person, any excessive noise source.”
\nThe Hawaii Department of Transportation proposes to remove and replace guardrails,
\nguardrail end treatments and reflector markers, perform grading, grubbing and where
\npossible, paving under guardrails in 18 noncontiguous locations along Kuhio Highway,
\nState Route 56, between Mile Post 10.26 to Mile Post 24.0.
\nThe Hawaii Department of Transportation would like to conduct construction related
\nactivities on Sunday night to Friday morning (6:00 p.m. to 7:00 a.m.) from February 1,
\n2024, to June 30, 2024.
\nThe Department of Health will retain and consider all written comments received not
\nlater than thirty (30) days after the date of publication of this notice. If comments
\nreceived warrant it, the Department may hold a public hearing, after at least thirty (30)
\ndays public notice, on the variance application. The final decision will be made on the
\nbasis of the application, related documents, written comments and the public hearing,
\nif any.
