PUBLIC NOTICE <\/p>\n

<\/b><\/font><\/p>\n

Pursuant to sections 91-3(b) and 91-4(b)(2), Hawaii Revised Statutes (HRS), notice is hereby given that the Department of Human Services (DHS) has adopted emergency rules chapter 17-796.2 relating to the Hawaii Relief Program. <\/p>\n

The emergency rules were adopted on April 24, 2026, and shall be in effect for 120 days pursuant to section 91-3(b), HRS. The emergency rules as adopted are as follows:<\/p>\n

<\/font>CHAPTER 17-796.2 HAWAII RELIEF PROGRAM<\/p>\n

<\/b><\/u><\/font>The chapter establishes the Hawaii Relief Program (HRP) that provides non-recurring short-term payments to assist with housing, utility, or automobile expenses, or a combination of these expenses, for families with minor dependent children, who are in need of assistance to address an episode of financial need due to an extenuating circumstance. The HRP payments are not intended to address a family’s recurring needs and will not extend beyond four months. The chapter defines the criteria that families must meet in order to be eligible and receive an HRP payment; describes the disposition of valid applications received from families; outlines the due process if a family disputes an eligibility determination or payment amount; and describes fraud referral and the repayment process if HRP payments were overpaid on behalf of families. <\/p>\n

1. §17-796.2-1, <\/font>Purpose<\/u><\/font>. This section states the purpose of the chapter and the effective date of the rules.<\/p>\n

2. §17-796.2-2, <\/font>Definitions<\/u><\/font>. This section provides definitions to the following terms which are referenced within the chapter:
\n A. Adult
\n B. Applicant
\n C. Arrears in payment
\n D. Automobile
\n E. Categorically eligible
\n F. Department or DHS
\n G. Department’s designee
\n H. Dependent child
\n I. Earned income
\n J. Episode of financial need
\n K. Excluded individual
\n L. Extenuating circumstance
\n M. Family unit
\n N. Family unit member
\n O. Fraud
\n P. Hawaii Relief Program payment or HRP payment
\n Q. Housing
\n R. Payee
\n S. Private organization
\n T. Resident
\n U. Self-employment
\n V. Specified relative
\n W. Unearned income
\n X. Utility expense
\n Y. Valid application<\/p>\n

3. §17-796.2-3, <\/font>General requirements<\/u><\/font>. This section specifies the general requirements that must be met to receive an HRP payment which include a dependent child in the family unit who resides with an adult specified relative, or a pregnant woman without a dependent child who is in the third trimester of pregnancy; the applicant or at least one family unit member meets U.S. citizenship or qualified immigrant status; all members of the family unit are residents of the state; the family unit’s total gross income does not exceed the established threshold; and the family unit demonstrates an episode of financial need. In addition, a family unit may be deemed categorically eligible if the family unit currently receives assistance from certain government means-tested programs. The section also states that HRP payments cannot duplicate or replace other housing, utility, or automobile payments the family unit received or is expected to receive from other government entities, private organizations, or individuals. <\/p>\n

4. §17-796.2-4, <\/font>Application processing requirements<\/u><\/font>. This section outlines the application requirements including applicants providing additional information or verification to establish their eligibility for the NRST housing or utility payments; outlines how a family unit’s total gross income is calculated; and provides the timeframe when a disposition must be made on a family unit’s application.<\/p>\n

5. §17-796.2-5, <\/font>HRP payments<\/u><\/font>. This section lists the maximum amounts for each housing, utility, and automobile payments; how expenses are prorated when a family unit shares an expense with an excluded individual; provisions to which the HRP payments may be received; and how the HRP payments may be issued. <\/p>\n

6. §17-796.2-6, <\/font>HRP payment issuance<\/u><\/font>. This section describes how HRP payments are applied to a family unit’s expenses.<\/p>\n

7. §17-796.2-7, <\/font>Compliance requirements for payees of HRP payments<\/u><\/font>. This section outlines the requirements that a payee must meet before an HRP payment is made. Requirements include compliance with any applicable federal, state and county laws, and with the rules and regulations of the U.S. Internal Revenue Service and the State Department of Taxation.<\/p>\n

8. §17-796.2-8, <\/font>Disposition of application<\/u><\/font>. This section defines the date of eligibility; outlines when adjustments are made when NRST payments are duplicative of other payments that a family received; outlines reasons when an application is denied or discontinued; and describes the notification requirements when an application disposition is made.<\/p>\n

9. §17-796.2-9, <\/font>Review of an eligibility determination or payment<\/u><\/font>. This section describes the requirements when an applicant disputes a determination of ineligibility or an NRST payment amount and the required due process. <\/p>\n

10. §17-796.2-10, <\/font>Overpayment and fraud<\/u><\/font>. This section describes the reasons for overpayments; notification to the family unit when an overpayment claim is made; how repayment to the State is made including collection via tax setoff; and penalties under federal and state laws if fraud is committed by an applicant or family unit.<\/p>\n

11. §17-796.2-11, <\/font>Termination, denial, or reduction for insufficient funds<\/u><\/font>. This section outlines the options available to the department if there are insufficient funds to continue the NRST housing and utility payments described in the chapter.<\/p>\n
