<\/i><\/font>These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Department of Hawaiian Home Lands.<\/font><\/p>\n

\nREQUEST FOR RELEASE OF FUNDS<\/p>\n

<\/b><\/font><\/p>\n

On or about June 1, 2018, the Department of Hawaiian Home Lands (DHHL) will submit a request to the HUD for the release of funds under Title VIII-Housing Assistance for Native Hawaiians of the Native American Housing Assistance and Self Determination Act (NAHASDA) of 1996, as amended, to undertake a project known as Pi’ilani Mai Ke Kai Infill Residential Lots for the purpose of construction, inspection and testing, and individual wastewater disposal system installation as well as housing mortgage assistance and administrative project support for five homes on infill lots within an established subdivision of the residential development named, “Pi’ilani Mai Ke Kai”.<\/font><\/p>\n

\nFINDING OF NO SIGNIFICANT IMPACT<\/p>\n

<\/b><\/font><\/p>\n

The DHHL has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the DHHL Kaua’i District Office (3060 Eiwa St., Lihu’e) and the O’ahu District Office (91-5420 Kapolei Pkwy., Kapolei, HI 96707) and may be examined or copied weekdays 9:00 A.M to 4:00 P.M.<\/font><\/p>\n

\nPUBLIC COMMENTS<\/p>\n

<\/b><\/font><\/p>\n

Any individual, group, or agency may submit written comments on the ERR to the DHHL Chairperson’s Office at P.O. Box 1879, Honolulu, HI 96805. All comments received by May 31, 2018 will be considered by the DHHL prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.<\/font><\/p>\n

\nENVIRONMENTAL CERTIFICATION<\/p>\n

<\/b><\/font><\/p>\n

The DHHL certifies to HUD that Jobie M.K. Masagatani in her capacity as Chairman consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the DHHL to use Program funds.<\/font><\/p>\n

\nOBJECTIONS TO RELEASE OF FUNDS<\/p>\n

<\/b><\/font><\/p>\n

HUD will accept objections to its release of fund and the DHHL’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the DHHL; (b) the DHHL has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at 1132 Bishop St., Suite 1400, Honolulu, HI 96813. Potential objectors should contact HUD to verify the actual last day of the objection period.<\/p>\n
